When I was reading his OP, as soon as I read he was holding the game in a SHOP I knew that was the deal breaker. The tip jar is not smart either. As long as you are playing in a HOME and do not collect any kind of rake you should be good.

once i read that there was a tip jar and it was in a shop i knew there may be troubles. although they said that the shop is actually on his residential property since it was a dairy farm and the guy lives on the property as well
I was utterly amazed at the whole situation, I stood their with my hands up in total disbelief. As they took my name when the processed me out I talked to the cop a bit. I asked him why they were busting the game. He said because it was an illegal game. I asked him what made the game illegal. He said because you guys were making a profit. I said, "I will testify that there is no way these guys are taking a cut."
He then said, "Well, there's no way these guys are running this thing for nothing."
My jaw dropped.
At this point he shuffled me out as he took more names.
