Chips: 1,728 | | Sorry, the ownership info on the brands was just for informational purposes. I don't for a minute doubt that people on computer message boards tend to have little regard for the rights of copyright holders. I'm not a lawyer or anything, but I never knew that you could violate a copyright if it is for your personal use. Does that fall under the fair-use provisions in 17USC? Quote: |

Chips: 1,728 | | To reinterate, I am not an attorney and as such would not be giving out legal advice (there's plenty of non-lawyer jerks on newsgroups that will be glad to give you misguided legal advice.) If you want to be advised of the potential legal ramifications, you should consult an attorney who has been admitted to the Bar of your state and/or the Federal Bar.
First of all, outside of counterfeiting money or goods, I've never heard of anyone going to jail for a copyright violation, but you might end up being a defendant in a civil matter. Though I would someone doubt it, if you're going to just use those chips for your personal use and not redistribute them. I wouldn't go around inviting Harrah's executives to your home games though .
The Horseshoe on your label appears to resemble the Horseshoe logo that is currently owned by Harrah's Licensing LLC of Las Vegas NV. Note the ® that follows some of the uses of Horseshoe logos in that font (usually the first occurance on the page), it designates it as a Registered Trademark. You can read Harrah's claim to trademarks used on their web sites at http://www.harrahs.com/about_us/trademarks.html
Ironically enough, you might be able to replicate the Binion's Horseshoe chip (less Horseshoe logo) at some point with impunity, since they're out of business and not likely to renew their claims to the mark Quote: |

Chips: 222 | | that is an interesting idea pocketrocket... i might have to look in to that.... and about the Harrahs executives... i wish they would play in our games... i would love to take their bank haha
EDIT do you think that it would still be copyrighted it i changed the Binion's in the horseshoe logo to my last name? or would it be exempt from the laws because of the different name and the difference in logos?
Is there a lawyer in the house?? |

Chips: 1,728 | | Sorry, if I wasn't clear, but it's the Horseshoe text logo itself that is a Registered Trademark, and thus subject to infringement. Again, I may have raised things beyond what they should be, but if you sincerely want to avoid any implication of infringement, you would probably have to avoid using the Horseshoe trademark (i.e. using that particular font for Horseshoe.) You could use that font, or at least one similar to it, as they used for the tournament chips that were done a while back for some other wording, but it would appear to me (for whatever that's worth) that you would be infringing on the their mark if you used it to represent "Horseshoe". Again, an attorney would be better qualified to advise you on that, not me, and legitimate lawyers do not give legal advice on web boards. Quote: |
