Paypal is not a shipper.
Neither does the standard post office receipt - even IF it has the weight and zipcode on it. All that proves is that you sent something - but not necessairly the item(s) in question.
For a shipper to have PROOF (talking court of law proof here binky) - you need the kind of traceability that you get from the standard UPS/Fedex type of tracking.
As far as businesses go - you really need to do your homework on the legalities of transactions - even barter transactions. Lots of sellers on EBAY get this wrong - and it is spelled out very clearly in their T&C. Plainly put - you have entered into an agreement to provide goods for money. This agreement is binding. The agreement is not complete until the ownership of the goods is transferred to the buyer. In layman terms - this is called POSESSION - or they need to have RECEIVED the goods in question.
Saying something shipped means squat. Insurance/delivery confirmation/tracking are there to protect SELLERS rights- not the buyers.
If DELL ships out a truckfull of computers - and they are al destroyed by an accident - are the customers out of luck? NOPE. What if Dell forgot to get that insured shipping? NOPE - Dell is still on the hook. The goods are not in the poession of the buyer yet so ownership transfer has not taken place. |

Clearly, you don't know jack about the way this is supposed to work. Just admit it, admit you're wrong, and stop all the nonsense. NOONE here is buying it. The longer you try to "get away" with whatever you think you're getting away with, the worse it will become for you.
A real man would admit he's wrong in this situation, and take the consequences. Doesn't seem like that matters to you. You continue to point fingers at everyone else, while taking no responsibility for your part. What a piece of trash. Man up! Make good on these sales, and move on down the road. Your ebay rating doesn't mean jack here either. Stop bragging about your ebay transactions. No one cares! All they care about is they paid for stuff and haven't gotten it. You haven't done anything except take their money. I'm sure you'll see this, but I also know you don't have the guts to respond. Make this right for the people that you've mislead, lied to and stolen from. What a low-grade moron you must be to continue to think it's in your best interest to continue on this path. Hopefully by now enough people have been warned so that you'll never sell another poker chip for the rest of time.

Well yesterday afternoon I get a response from this seller - listed as a Betty (hidding behind mom's name?) that they had refunded my money because "I put 2 many rules for this transaction." Too many rules? The seller agreed to my requests (I have all correspondence that was done via eBay My Messages). They also said " i have been on ebay for many years you have been on ebay for only days,so i have to protect myself". After reading this thread this comment is just hysterical.
I contacted eBay Live Help last night and they suggested I file a Seller Non-Performance report with their SafeHarbor department which I did. All of this before reading this thread today. My guess before I read this was that the seller didn't like the amount the chips sold for and is using my requests as their reason to get out of the transaction. As I pointed out to eBay I don't know how a seller is allowed to post an auction and then without correspondence with the winner cancel/refund the money. Surely eBay has rules regarding this or I would think this sort of practice would be rampant throughout the site.
Silly, silly uni-quely-mine (aka highway-to-junk) you should have completed the business transaction and I possibly would never have seen this thread. Now this link maybe interesting reading for the eBay complaint department.
Edit: BTW can eBay sellers just decide on a whim that they can cancel an auction transaction with no correspondence with the buyer? |
