Missing chips: Who's wrong here?

Here's the story:

I agreed to buy $200 worth of chips (MGM Detroit Quarters). This person WAS not a chiptalker, but I was referred to him. He has since joined chiptalk in an attempt to sell chips here.

1. I sent payment by check, because he didn't want paypal.
2. Check cleared my account, I have the copy of it to prove it.
3. He said he would mail out the chips. A few days later, he said he had forgot, but that he did eventually get them out Saturday, May 3rd, priority mail.
4. I don't get the chips for over a week. The package only had to travel a couple hundred miles, so I'm convinced it's not coming.
5. I contact the seller, he says "It's your loss". I told him that I have no proof that he actually mailed the chips, I need to see that the Post office screwed it up. He said he would find the receipt (lie), but still hasn't presented it to me.

Am I wrong in thinking that unless he can prove he mailed it on that day, he hasn't fullfilled his obligation as the seller? Let me know if I'm wrong here.

I know it's good to get insurance (which I always do when I ship quality items), but the issue isn't the post office here. He is lying to me about sending the chips, and trying to blame the post office. He hasn't shown me a receipt yet, and until he does, I have no reason to believe him.

Is there anything I can do?

At this point, I don't think I can get my money back. But, if he doesn't show me the receipt and still refuses to refund, I am going to let the rest of the chiptalk community know who it is, so that you don't buy from him and get screwed as well. Hopefully loss of business would be enough motivation to fix this transaction.


UPDATE - I've now found out there are AT LEAST two others who have the same suspicions/problems with the same seller. Needless to say, don't buy MGM Detroit chips until further notice.

Seller should be able to provide a receipt, tracking number or other evidence that they did ship the items you paid for. You paid good money, and he needs to step up. If he's not willing to do that, let everyone know who it is.

Thinking about order from BCC? I did. And it took a year and half.

Ask BCC: Why does it take 6-8 months when you promised 4-5 weeks? How come you didn't look at the chips before you sent them out? Why does it take 6+ months for BCC to make good on a bad order after waiting 6-8 months in the first place?

They may show up. I won an ebay auction in February, and when the chips didn't show up after 3 weeks, the seller agreed to refund my money. She said, "if they show up, send me the money." I forgot about it until they showed up last week at my house, I was shocked. (3 months later.)

I know a lot of people refuse to use the USPS for packages, it seems to me UPS or fedex are worth the extra money b/c of their excellent record and tracking systems.

So, I don't know how long you should give this guy, but they may show up.

No and no.

When I ship, I always do delivery confirm/insurance. He said that was crazy and that he never does that unless specified by the buyer (he told me that after I realized there may be a problem and the chips may be lost). I would have paid the extra $2 for insurance, but it wasn't ever mentioned during the purchase of the chips.

Like I said though, I'm 99% confident that the chips never got mailed out.

I am giving the chips a little more time to get here, and giving him a chance to refund my money if he can't provide a receipt. I just wanted to make sure I was right in my thinking.

If neither of those things happen, I'll make sure everyone on CT knows not to buy from this guy.
