I am arguing that I don't use the elements in the same way to produce the same look ... hence it is an original 'composition'. Which is correct.
A simple example would be the use of circular rings in a logo ... just because the Olympics uses 5 rings in their design doesn't mean that no-one can ever use a ring in a logo design, even 5 of them! This is obviously ridiculous. Certainly, you can't use then in the same position with the same colors ... or even anything that would IMPLY that ... but you can certainly use rings in a logo design!!
I appreciate what MS Patton is trying to do. He wants to protect his designs and his exclusive business. I respect that, but he is becoming over-zealous and remarkable unprofessional about it. This is not an issue you resolve by throwing it in front of a public forum of people. I tried to resolve this privately with him and, honestly, thought the matter was resolved.
