How do you handle this situation?

This situation came up tonight at our home game, and I'm curious how you'd handle it if you were running the game. (and how you'd handle it if you were involved in the hand)

4-8 holdem with a kill. the hand in question is a kill pot. 2 limpers, 1 raise (to 16), I reraise (to 24), the $8 blind (kill blind) folds, and one limper folds, other 2 players call.
Pot is $88. 3 players.
Dealer burns, and begins to deal the flop off 1 card at a time. The first card off is a Joker. (new deck just put in, and obviously jokers should have been removed). The dealer of this hand also happens to be running the game (and taking a rake). He also was the limper (of $ who folded to two raises.

If it's your game, what do you do?

One of the live players says it should be a dead hand, one player (that folded preflop) says you should just keep dealing. I say nothing, as I'm in the hand and don't think it's appropriate to comment.

Dealer says it's a dead hand and everyone is entitled to their money back. The 3 live players get $24, and the 2 that folded get $8.

If you were involved in the hand, what would be your reaction?

Remove the Joker and deal the next card in it's place.

I don't mind the decision. The rulebook says ignore the joker.

I would ignore and keep dealing... though what if the burn card is a joker... don't usually check so would you here? Never really thought about it. Just the fact that he's pulling a rake would want me to raise a stink about it Though I wouldn't get worked up about it otherwise... at least pre-flop

I honestly believe the dealer tried to do the right thing, but I disagree with his decision.
I thought, as most of you, that it should be ignored. But I especially do not agree with the players that had folded getting their money returned.
I said nothing, as it wasn't a very big deal, but I did think it was an interesting situation. And I definately would have handled it differently.

Above all else, I believe that the people involved in the hand should not be influencing the decision.
A situation that I see fairly often is when a mistake is made in the dealing of the cards, (i.e. tournament- player has paid for a seat but has not arrived. He has chips, and should be dealt a hand. But dealer omits dealing him a hand, and it is only noticed after some players have looked at their cards)
It seems that all-to-often the loudest player gets their way. They muck their 7-2 offsuit and demand a redeal.
At the very least, I ask for consistency.

Exactly what I would insist if it were not my game.

However this is a perfect example why EVERY time we play at my house, before one card is dealt to a player, I suit and count out the cards and fan them on the table while everyone is sitting and ready to play, just like they do in the casinos.

I sometimes get some eye rolling like it is an unnecessary task, but it is a good habit to get into EVERY time you sit down to play, or get out a new deck during play.

We had a situation just a few weekends ago that validated my actions, where I grabbed one half of a matched set of BAY 101 red casino KEM's, and as it turned out (discovered while suiting and counting) that the Ace of Clubs from the other deck had slid over to this deck so there were two of them in the deck I grabbed from the box.

If I had not suited and counted them ALL we would have started playing with 5 Aces in the deck, & two Ace of Spades. Not cool.

Another time while doing this with a brand new deck, it was discovered that there was a factory defect in the 6 of Clubs on my green ringback KEM's that showed on both the face and the back (a dark spot like a chunk of junk fell into the card during manufacturing) and we had to crack a new deck and shelve that deck until I could get a replacement card. This also would not have been noticed unless the entire deck was inspected prior to play.

If it were me, I'd ignore the joker and deal a replacement card. I can't really see a good reason for calling it dead. You can expose a burn card, deal an extra turn card, etc., and it doesn't kill the hand. So I don't see what the big deal about just pulling a card out that obviously doesn't belong in the deck.

Like you though, I don't think it's an overly big deal calling it a dead hand either. Just not what I would have done in my game.

Robert's Rules of Poker address just about every possible situation outside of house rules. If I'm not mistaken, this would be treated as a "boxed" card. Throw it off to the side, pull the next card out of the deck to make 3 on the flop and keep going.

In no way would this be a dead hand where everyone gets thier money back and you restart. I've never heard or seen that happen.
