The state runs a gambling operation (if not several), and doesn't want the competition. So first they strong-arm every potential competitor out of the way, then try to quash anyone even mentioning that there's competition for the state crime machine.
Leaving the morality of the nanny state aside, if a state allows legalized gambling under any circumstances, then it has no moral grounds to outlaw gambling period.
As for this specific case, the law is so flagrantly unconstitutional as to be laughable. But first, you've got to have grounds to sue (meaning you'd have to wait until the state actually filed charges) and second (as was mentioned), you've got to have the financial wherewithal to do it.
