The way I read it is that they were paying a flat fee for playing, perhaps by hour, night, etc.. Perhps not raking each pot.

probably. this is how I would run it if I were to open a card room. With rake boxes in the tables, the police have an open and shut case... with the profit in my pocket they don't really have proof that it's not just friends playing poker.
