A few quick comments (mostly meaningless) then let's put it to rest.. First... I don't know if someone could copyright a firedancer, it is something that has been around for a long time, it would be like trying to copyright a Phoenix.
Secondly, in this specific instance, in a case where I would venture to say that Dave Matthews most valuable asset, his music, is freely shared with his fans that
want to tape his shows, that making poker chips using a symbol that has come to represent his band, is more or less a non-issue provided they are not being mass marketed by a company (from china

Granted, I was not one of those on a soap box during the sun-fly diatribe, so I am much less sensitive to these issues, my feeling is that if something is part of the public consciousness, then replicating it for personal use is, well, a very small issue in the grand scheme of things...and I would include sports teams logos, movie names/logos, and many other things under that umbrella. just remember, as per post #1 in this thread, i spent alot of time pursuing peace, love and happiness!
